Directive 2008/98/EC (the Waste Framework Directive – WFD) provides for the application of mechanisms allowing that certain materials under specific circumstances may be used as products without the administrative measures associated with waste management being applied to them. These mechanisms include the end-of-waste status, which, in accordance with Article 6 of the WFD, may be conferred to certain waste after it has been subjected to a recovery operation, provided that evidence is given of its compliance with previously defined criteria at Community level or, in the absence thereof, at Member State level.
This Ministerial Implementing Order establishes the criteria for the assignment of the end of waste status (EWS) to rubber materials derived from used tyres (material originating from shredding, fragmenting or granulating used tyres, intended to be applied in bound materials (aggregated by a binder) and non-bound materials (application to bulk without using binders).
