Explanation

Many scientific journals and respected organisations (EASA, EASAC, INRA, CNRS, ANSES, etc.) share the view that neonicotinoids have a huge impact on various aspects of the environment and on non-target organisms, such as bees, macroinvertebrates and even birds. A recent EASA study also identified a risk to human health (impact on normal nervous system development).

Summary

This text implements Article 125-1 of Act No 2016-1087 of 8 August 2016 on the recovery of biodiversity, nature and landscapes, which bans the use of plant protection products containing one or more neonicotinoid active substances and of seeds treated with these products from 1 July 2020.

Notice: the decree specifies the neonicotinoid substances covered by the ban on using plant protection products that contain them and on seeds treated with them in accordance with Article L253-8 of the Rural and Maritime Fishing Code [code rural de la pêche maritime].

Hereby decrees:

Chapter III of Heading V of Book II of the regulatory part of the Rural and Marine Fisheries Code is amended as follows:
Section 6 of Chapter III of Title V of Book II of the regulatory part of the Rural and Maritime Fishing Code is amended as follows:

Article R253-46 is replaced by the following provisions:
1° Article D253-46-1 is renumbered to Article D253-46-1-1;

‘The neonicotinoid substances referred to in Article L253-8 are the following:
2° A new Article D253-46-1 is inserted, reading:

‘Article D253-46-1. The neonicotinoid substances referred to in Article L253-8 are the following:

Acetamiprid;

Clothianidin;

Dinotefuran;

Imidacloprid;

Nitenpyram;

Thiacloprid;

Thiamethoxam.’

The Minister for the Environment, Energy and Marine Affairs, responsible for International Climate Relations, the Minister of Agriculture, Agrifood and Forestry, Government Spokesperson, and the Minister for Social Affairs and Health shall be responsible for the implementation of this decree, which shall be published in the Official Journal of the French Republic.
The Minister of State for the Ecological and Inclusive Transition, the Minister for Solidarity and Health and the Minister for Agriculture and Food shall be responsible, within the scope of their respective competences, for the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
