70. Ordinance of the Provincial Government of 23 June 2020, amending the 2014 Tyrol Gas, Heating and Climate Control Systems Ordinance

On the basis of Article 3(2) of the 2013 Tyrol Gas, Heating and Climate Control Systems Act, Provincial Law Gazette No 111/2013, last amended by the Act published in Provincial Law Gazette No 144/2018, the following is hereby decreed:


The 2014 Tyrol Gas, Heating and Climate Control Systems Ordinance, Provincial Law Gazette No 80/2014, as amended by the Ordinance published in Provincial Law Gazette No 9/2018, is amended as follows:

1. In § 2, the following provision is added after paragraph 5 as paragraph 6:
1. In § 2, the following provisions are added after paragraph 5 as paragraphs 6, 7 and 8:

‘(6) For new buildings within the meaning of § 2(7) of the 2018 Tyrolean Building Code, Provincial Law Gazette No 28/2018, as amended, and for larger renovations within the meaning of § 2(27) of the 2018 Tyrolean Building Regulations, the use of solid fossil fuels under Annex 1 and liquid fossil fuels under Annex 2 in central heating systems is not permitted.’
‘(6) For new buildings within the meaning of § 2(7) of the 2018 Tyrolean Building Code, Provincial Law Gazette No 28/2018, as amended, the use of solid fossil fuels under Annex 1 and liquid fossil fuels under Annex 2 in central heating systems is not permitted

(7) For larger renovations within the meaning of § 2(27) of the 2018 Tyrolean Building Regulations, the use of solid fossil fuels under Annex 1 and liquid fossil fuels under Annex 2 in central heating systems is not permitted. By way of derogation from this, the use of solid fossil fuels under Annex 1 and liquid fossil fuels under Annex 2 in central heating systems is still permitted if an application is made to the building authority for the larger renovation within the meaning of § 2(27) of the 2018 Tyrolean Building Regulations before 31 December 2024 and if the existing boiler of the central heating system in question is no more than 10 years old at the time of application.

(8) Paragraphs 6 and 7 do not apply to central heating systems for which the inspection findings were submitted to the authority no later than 31 December 2020.’

2. § 3(7) and (8) read as follows:


(8) The limit values specified in paragraph 7 may be exceeded if the base level determined at the property boundary in accordance with the latest technology is not increased by more than 3 dB.’

‘(4) Heating systems with self-regulating devices for the separate regulation of the temperature in each room or, where technically suitable, in a designated heated zone of the building unit are to be fitted, where technically and economically feasible.’

4. § 6(5) is deleted:

5. The previous § 6(6) is given the paragraph number ‘(5)’.

6. The new § 6(5) reads as follows:

‘(5) In new buildings, gas-fuelled central heating systems that are also the small furnaces shall be fitted with a condensing boiler and configured so as to maximise the time during which this boiler is operated in the energy-saving mode. In case of replacement of gas-fuelled central heating system, this applies only if the existing installation was already equipped with a condensing boiler, or otherwise if that is technically possible without disproportionate added cost. For oil-fuelled central heating systems the second sentence applies mutatis mutandis, if the replacement of such central heating systems is permitted.’

7. § 28(2) reads as follows:

‘(2) This Ordinance governs the following areas:

a) in accordance with the provisions of Directive 98/34/EC of the European Parliament and of the Council laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, OJ 1998, L 204, p. 37, last amended by Regulation (EU) 1025/2012, OJ 2012 L 316, p. 12 (notification number 2013/0703/A) and

b) in accordance with the provisions of Directive (EU) 2015/1535 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services, OJ 2015 L 241, p. 1 (Notification No XXXX/XXXX/X).’
b) in accordance with the provisions of Directive (EU) 2015/1535 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services, OJ 2015 L 241, p. 1 (Notification No 2019/651/A).’

Article II

This Ordinance shall enter into force on the day following its promulgation.
