Explanation

Directive (EU) 2018/851 on waste encourages Member States to take appropriate measures to prevent waste generation. In addition, one of the objectives of the European action plan for the circular economy (COM (2020) 98) is to improve the durability and repairability of products. The stakeholder consultation held in the context of the Roadmap for the circular economy, which was presented by the Government on 23 April 2018, resulted in measure No 10, which provides for mandatory information on the repairability of electrical and electronic products. The measure aims to promote responsible consumption by improving consumer information through the establishment and mandatory display of a simple repairability index for some of these products. This index aims to inform the consumer regarding how easy it is to repair the product concerned. This measure thus aims on the one hand to compensate for the asymmetry of information between consumers and manufacturers or distributors concerning the repairability of products and, on the other hand, to encourage manufacturers to integrate repairability criteria into the design of their products, thus tending towards products that are more durable because they are more robust because they are ‘eco-designed’. With this measure, a reasonable ambition is to reduce breakdowns of electrical and electronic products giving rise to repair in the network of French repairers to 60 %, within five years, as compared to around 40 % today. From an environmental standpoint, this measure will allow France to pursue its national objective of reducing the resource consumption linked to French consumption: to reduce resource consumption relative to GDP by 30 % compared to 2010, by 2030 (Law No 2015-992). More repairable and therefore more durable products will effectively lead to a reduction in resource consumption (reduction in the need for new products), a reduction in the quantity of waste electrical and electronic products and an associated reduction in greenhouse gas emissions.

Summary

The repairability index consists of a score out of ten intended to be displayed at the time of purchase to inform consumers of the categories of electrical and electronic products. This score is obtained by dividing an overall score of one hundred points by ten according to five criteria, each scored out of twenty and of equal weight, making it possible to assess the repairability of the products concerned. These criteria are as follows: documentation provided by the manufacturer, ease of disassembly of the product, availability of spare parts, relationship between the price of the most expensive spare part and the price of the original product, usage counter (optional) or other criteria specific to the category of products concerned. The Decree covers all electrical and electronic equipment intended for consumers. For each category of electrical and electronic equipment, an order of the Minister for the Environment and the Minister for the Economy and Finance shall specify all of the criteria and sub-criteria including criteria specific to the category as well as the methods of calculating the index. The Decree nonetheless provides for gradual implementation, starting with the following categories of products: washing machines, smartphones, laptops, televisions, electric lawn mowers (battery, corded, robot). Producers, importers, or other parties placing electrical and electronic equipment on the market shall be required to calculate the index for the categories of products concerned, and to make this information available. The Decree includes the dates and procedures for its entry into force. An umbrella order shall be promulgated to specify the display methods, markings and general parameters for calculating the repairability index. Orders shall be promulgated to specify the more specific methods of application for each category of products.

Notice: this Decree defines the implementing rules of Article L. 541-9-2 of the Environmental Code, which provides for the introduction of a repairability index for certain categories of electrical and electronic equipment. It specifies in particular the criteria and the calculation method used to establish this index. Producers and importers of the equipment concerned shall communicate the repairability index and its calculation parameters free of charge to distributors and to any person who requests it. Distributors, including distance sellers, shall inform the consumer of the index repairability of the equipment concerned free of charge, at the time of purchase, by marking, labelling, displaying, or using any other appropriate process.

Target groups: producers, importers, distributors or other suppliers of electrical and electronic equipment, sellers of this equipment, and those using a website, platform or any other online distribution channel as part of their commercial activity in France.

Article 1

In Title IV of Book V of the regulatory section of the Environmental Code, a Chapter IV and a Section 1 are inserted, worded as follows:

‘Displaying the repairability index

‘Article R. 544-1.- The repairability index for electrical or electronic equipment defined in Article L. 541-9-2 of the Environmental Code consists of a score out of 10 to be brought to the attention of consumers when purchasing new equipment.
‘Article R541-210. - The repairability index for electrical and electronic equipment defined in Article L541-9-2 consists of a score out of ten to be brought to the attention of consumers when purchasing new equipment.
‘This index relates to each of this equipment’s models.

‘This index relates to each model of this equipment.

‘Article R. 544-2.- For the purpose of this Decree, the terms are defined as follows:

‘1. “Making available on the market”: any supply, within the context of a commercial business, of electrical or electronic equipment intended for distribution or use on the national market, for consideration or free of charge;
‘Article R541-211. - For the purposes of this section the following definitions apply:
‘1. “Making available on the market”: any supply of electrical or electronic equipment intended to be distributed or used on the national market in the course of a commercial activity, whether against payment or free of charge;

‘2. “Placing on the market”: the first instance of the electrical or electronic equipment being made available on the national market;

‘3. “Producer”: any natural or legal person who manufactures a piece of electrical or electronic equipment or has such equipment designed and markets it under their own name or trademark;
‘3. “Importer”: any natural or legal person who places electrical or electronic equipment from Member States of the European Union or third countries on the national market;

‘4. “Importer”: any natural or legal person who places electrical or electronic equipment from Member States of the European Union or third countries on the national market;
‘4. “Seller”: any natural or legal person who, within the context of a commercial business, makes electrical or electronic equipment available to consumers on the market by selling, including remotely;

‘5. “Distributor”: any natural or legal person in the supply chain, other than the producer or the importer, who offers electrical or electronic equipment for sale on the national market;
‘5. “Distance selling”: contract entered into remotely between a professional seller and a consumer, within the context of an organised sales system, without the simultaneous physical presence of the professional and the consumer, by the exclusive use of one or more distance communication techniques until the contract is concluded;

‘6. “Seller ": any natural or legal person who, within the context of a commercial business, makes electrical or electronic equipment available to consumers on the market by selling, including remotely;
‘6. “Model”: a version of a piece of equipment, all of the units of which share the same relevant technical characteristics for the purposes of calculating the repairability index.

‘7. “Distance selling”: contract entered into remotely between a professional seller and a consumer, within the context of an organised sales system, without the simultaneous physical presence of the professional and the consumer, by the exclusive use of one or more distance communication techniques until the contract is entered into;
‘The other terms are understood in accordance with the provisions of Article R543-171-2, “producer” meaning “manufacturer” within the meaning of this Article.

‘8. “Model”: a version of a piece of equipment, all of the units of which share the same relevant technical characteristics for the purposes of calculating the repairability index.
‘Article R541-212. - I.- For the electrical or electronic equipment that they place on the market, producers or importers shall establish the repairability index as well as the parameters used to establish such in accordance with the procedures specified in the Order referred to in Article R541-214(III).
‘II. - For each of the equipment’s models that they place on the market, producers and importers shall inform distributors or sellers, free of charge and in a paperless format, at the time of listing and delivering the electrical and electronic equipment, of:
‘1. The repairability index in accordance with the conditions and the signs provided for by the Order referred to in Article R541-213(I);
‘2. The parameters which enabled the repairability index to be established, in accordance with the format provided for in the Order referred to in Article R541-213(I).
‘III. - Where the distributor and seller are not the same, the distributor shall inform the seller, free of charge and under the same conditions mentioned in II, of the index and the parameters of its calculation at the time of referencing and delivery of electrical and electronic equipment.
‘IV. - In addition, the index may be affixed directly to each equipment or to the packaging by labelling or marking, in accordance with the signs provided for in the Order referred to in Article R541-213(I).
‘V.- The information mentioned in II shall be communicated free of charge by producers and importers, within 15 days, to any person who requests such for a period of at least two years after the last unit of an equipment model is placed on the market.

‘Article 544-3.-
‘Article R541-213. - I. - Where electrical or electronic equipment is offered for sale in stores, the seller shall visibly indicate, in accordance with the procedures and the signs prescribed by order of the Minister responsible for the environment and the economy, the repairability index provided by the producer or importer, on each piece of equipment proposed for sale, or in the immediate vicinity.
‘II. - Where electrical or electronic equipment is offered for sale at a distance, the seller shall display the repairability index visibly in the presentation of the equipment and in the vicinity of its price, in accordance with the terms and conditions laid down in the Order mentioned in I.
‘III. - The seller shall also make available to consumers the parameters which enabled the establishment of the repairability index of the equipment, by any appropriate process.

‘I.- For the electrical or electronic equipment that they place on the market, producers or importers establish the repairability index as well as the parameters used to establish it in accordance with the procedures specified in the relevant Order.
‘Article R541-214. - I. - The repairability index shall be calculated using the following parameters:
‘1° A score out of twenty relating to the period of availability of technical documentation, instructions for use and maintenance instructions to producers, repairers and consumers;

‘II.- For each model of equipment that they place on the market, producers and importers inform distributors or sellers, free of charge and in a paperless format, at the time of listing and delivering the electrical and electronic equipment, of:
‘2° A score out of twenty relating to how easily the equipment may be disassembled construed as the number of disassembly steps required for individual access to the spare parts, and characteristics of the required tools and the fastenings between the spare parts;

‘a) the repairability index according to the methods and signage provided for in the relevant Order.
‘3° A score out of twenty relating to the period of availability of the spare parts on the market and to the delivery times to producers, spare parts distributors, repairers and consumers;

‘b) the parameters used to establish the repairability index, according to the format provided for in the relevant Order.
‘4° A score out of twenty relating to the ratio between the price of the parts sold by the manufacturer or importer and the price of the equipment sold by the manufacturer or importer, calculated according to the methods provided for in the relevant Order;

‘III.- When the distributor and seller are not the same, the distributor informs the seller, free of charge and under the same conditions mentioned in a) and b), at the time of listing and delivering the electrical and electronic equipment, of the index and its calculation parameters.

‘IV.- The index may also be affixed directly to each model unit or to the packaging using a label or marking, in accordance with the signage rules provided for in the relevant Order.

‘V.- The information mentioned in paragraph 2 is communicated free of charge by producers and importers, within 15 days, to any person who requests it for a period of at least two years after the last unit of an equipment model is placed on the market.

‘Article 544-4.-

‘I.- When the electrical or electronic equipment is offered for sale in shops, the seller displays the repairability index supplied by the producer or importer in a visible manner on the equipment being offered for sale, or in the immediate vicinity of this equipment, according to the methods and the signage provided for in the relevant Order.

‘II.- When the electrical or electronic equipment is offered for sale in the context of distance selling, the seller displays the repairability index in a visible manner within the presentation of the equipment and close to the price, according to the terms and signage provided for in the relevant Order.

‘III.- The seller also makes available to consumers the parameters used to establish the equipment's repairability index, according to the format provided for in the relevant Order, through any appropriate process.

‘Article 544-5.- The repairability index and the parameters used to establish it are made available to the consumer by the producers or importers for a period of at least two years after the last unit of a model of the equipment in question has been placed on the market.

‘Article 544-6.-

‘I-. The repairability index is calculated using the following parameters:

‘a) A score out of 20 relating to the period of availability of technical documentation, instructions for use and maintenance instructions to producers, repairers and consumers;

‘b) A score out of 20 relating to how easily the equipment may be disassembled: number of disassembly steps required for individual access to the spare parts, and characteristics of the required tools and the fastenings between the spare parts;

‘c) A score out of 20 relating to the period of availability of the spare parts on the market and to the delivery times to producers, spare parts distributors, repairers and consumers;

‘d) A score out of 20 relating to the ratio between the price of the parts sold by the manufacturer or importer and the price of the equipment sold by the manufacturer or importer, calculated according to the methods provided for in the relevant Order.

‘e) A score out of 20 relating to criteria specific to the category of equipment in question.

‘II-. The repairability index is obtained by adding together the five scores obtained and then dividing this total by 10 to give an overall score on a scale from 1 to 10.

‘III-. For each category of electrical and electronic equipment, an Order from the Minister for the Environment and the Minister for the Economy and Finance specifies all the criteria and sub-criteria, including the criteria specific to the category, and the methods for calculating the index.

‘Article 544-7.- From 1 January 2024, a durability index supplements or replaces the repairability index for certain categories of equipment by including new criteria, in particular the reliability and robustness of the equipment.’
‘5° A score out of twenty relating to criteria specific to the category of equipment in question.
‘II. - The repairability index is obtained by adding together the five scores obtained and then dividing this total by ten to give an overall score on a scale from 1 to 10.
‘III. - For each category of electrical and electronic equipment, an Order from the Minister for the Environment and the Minister of the Economy and Finance specifies all the criteria and sub-criteria, including the criteria specific to the category, and the methods for calculating the index.
