Pursuant to Article 8(8) of the Act of 16 April 2004 on construction products (Journal of Laws 2020, items 215 and 471), the following is hereby decreed:

§ 1.The Regulation of the Minister for Infrastructure and Construction of 17 November 2016 on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon (Journal of Laws, item 1966, 2018, item 1233 and 2019, items 1176 and 2164) in the table in Annex 1 to the Regulation is amended as follows:
§ 1. The Regulation of the Minister for Infrastructure and Construction of 17 November 2016 on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon (Journal of Laws, item 1966, 2018, item 1233 and 2019, items 1176 and 2164) in the table in Annex 1 to the Regulation is amended as follows:

1) in lp. 1 the construction product group “Precast normal/lightweight/autoclaved cellular concrete products” is replaced by the following:

§ 2.For construction products which, before the date of entry into force of this Regulation, were not subject to an obligation to affix a construction mark consisting of pump units for drinking water supply systems, additives and admixtures for mineral-asphalt mixtures, railings and handrail kits for protection against falls, ventilation and air-conditioning products, the manufacturer of the construction product will not be required to draw up a national declaration when placing or making available on the national market such a construction product until 31 December 2021.
§ 2. For construction products which, before the date of entry into force of this Regulation, were not subject to an obligation to affix a construction mark consisting of pump units for drinking water supply systems, additives and admixtures for mineral-asphalt mixtures, railings and handrail kits for protection against falls, ventilation and air-conditioning products, the manufacturer of the construction product will not be required to draw up a national declaration when placing or making available on the national market such a construction product until 31 December 2021.

§ 3.For construction products for which the national system for assessment and verification of constancy of performance has been modified, consisting of precast normal/lightweight/autoclaved cellular concrete products, concrete reinforcing products: welded/soldered mesh, reinforcing mats, precast welded/soldered concrete products, safety and repair products: mortars and repair compounds, melted and injection-moulded products, products for drying masonry structures, rigid flooring products: tiles, mosaics, mesh and panel coverings, floor gratings, parquet, boards, composite and laminated elements, wood-based products, raised and recessed floors placed on the market as kits, roof systems with mechanically fastened flexible waterproofing products, including fixing systems, joints, edge treatment with or without thermal insulation, the manufacturer of the product may, when placing or making a construction product available on the national market, use national declarations of performance already drawn up until 31 December 2021.
