By this draft decree implementing Article R. 5132-86 of the Public Health Code for Cannabis, the French authorities intend to comply with the judgement of the Court of Justice of the European Union of 19 November 2019 in which the Court of Justice, referring to a question referred to a French court for a preliminary ruling, held that the provisions relating to the free movement of goods were applicable to CBD-based products and deduced from it that a national measure prohibiting the free marketing of the CBD constituted an obstacle to the free movement of CBD. However, it clarified that such a measure could be justified by an objective of public health protection, provided that it was necessary and proportionate (CJEU, 19 November 2019, Kanavape, C-663/18).
The purpose of this draft decree is to regulate the cultivation, import, export and industrial and commercial use of all parts of the hemp plant in France.
