The Copyright Act Amendment 202x, Federal Law Gazette (BGBl.) I No XX/XXXX (the Government Bill, 1178 d.B., was sent to the lower house of the Austrian Parliament (Nationalrat) on 18 November 2021; its adoption in the Nationalrat and the upper house of the Austrian Parliament (Bundesrat) can be expected in December 2021) introduces a new copyright-related right for producers of press publications, transposing into Austrian law Article 15 of Directive (EU) 2019/790 of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC.

Explanation

The aim is for producers of press publications to only be restricted in their individual powers of disposition to the extent that this is necessary to protect them against misuse of a dominant position by search engines and social media services on which they are dependent to avoid economic disadvantages.

Summary

The draft stipulates that the new right against market dominant online platforms and search engines must be asserted through a collecting society. Against such service providers, the right is therefore to be exercised only collectively and not by the individual producers of press publications.
