This Order pertains to the transformation of the special moped designation process by the Minister for Infrastructure and Water Management into a special moped approval by the Road Traffic Service [RDW] as the approval authority. In addition, this amending Order updates the permanent requirements applicable to special mopeds.

The requirements are necessary to ensure road safety. In some cases, the requirements link up with European and other requirements applicable to vehicle approval/authorisation, in particular Regulation (EU) No 168/2013. Setting requirements on the structure of special mopeds for the use phase provides the best and most direct assurance of road safety. Enforcement is possible when road safety is under threat. The requirements are also non-discriminatory because they apply regardless of the origin of the vehicle or driver. The requirements are proportionate because they only prescribe what is necessary to safeguard road safety.
This Order further implements the transformation of the special moped designation process (moped-like vehicles that do not fall under European vehicle regulations, in particular Regulation (EU) No 168/2013) by the Minister for Infrastructure and Water Management into a national type-approval by the Road Traffic Service [RDW] as the approval authority. In doing so, this amending Order updates the permanent requirements applicable to special mopeds.
