Explanation

There have been a not insignificant number of accidents involving buses where bus drivers have been seriously injured or killed in connection with a frontal impact accident. The Accident Investigation Board Norway has therefore recommended the introduction of technical requirements to the bus front to reduce the extent of damage and injury in connection with potential frontal impact accidents. It has also been raised by the labour unions that the buses need to become more crash resistant.

Summary

In order to reduce the scope of a frontal collision, the Norwegian Public Roads Administration is proposing to introduce a requirement that class I, II and III buses registered in Norway after 1 January 2023 shall satisfy Section 5 of UN Regulation 29 when the test is carried out in accordance with Annex 3 Test A, the front impact test and the impact energy shall be in accordance with Section 5.5.2.

Regulations relating to universal design of motor vehicles used for licensed transport etc.

Section 1: Scope of application

These Regulations apply to passenger transport requiring a licence on regular services and transport requiring a licence where the motor vehicle is used for transport for persons with disabilities, cf. Sections 4, 6 and 9 of the Professional Transport Act. The Regulations do not apply to Class I buses, with the exception of the provision in the fifth paragraph of Section 4

Section 2 Definitions

The definitions in Regulations of 5 July 2012 No. 817 relating to Approval of Motor Vehicles and their Trailers (“bilforskriften”) shall apply where appropriate.

Otherwise the following definitions shall apply to these regulations:

a) Motor vehicle for transport of persons with disabilities: Motor vehicle in licensed transport that is specially designed or equipped for transport for disabled people.

b) Passenger space: Space intended for the transport of passengers.

c) Seat: Space intended for seated passengers in fixed or removable furniture.

d) Wheelchair space: Space intended for passenger seated in a wheelchair.

Section 3. Approval

Buses covered by these Regulations must be approved by the Norwegian Public Roads Administration pursuant to the requirements set out in the Regulations relating to Motor Vehicles and their Trailers, as well as the requirements in Section 4. Upon approval, documentation must be provided that the requirements in Section 4 are met.

Passenger cars covered by these Regulations must be approved by the Norwegian Public Roads Administration pursuant to the requirements set out in the Regulations relating to Motor Vehicles and their Trailers, as well as the the requirements in Section 6. Upon approval, documentation must be provided that the requirements in Section 6 are met.

Documentation as mentioned in the first and second paragraphs shall be issued by the manufacturer of the bodywork, chassis, safety equipment or the complete motor vehicle, or by a competent independent laboratory.

Section 4: Requirements applying to buses

Buses covered by these Regulations shall comply with the requirements of UN/ECE Regulation 107-05, Annex 8.

In addition, buses used for passenger transport on regular services requiring a licence shall have the following:

a) Automatic stop announcement with voice messages and an electronic message board inside the bus located so that it can be clearly seen from a reserved space.

b) External broadcasting system (audio beacon) announcing which bus is arriving at the stop.

The choice of boarding device must be based on the structure of the bus. There shall be at least one wheelchair space in each bus.

Class II buses shall have seat belts that meet the requirements of UN/ECE Regulation No. 16-06. Attachment points for safety belts shall meet the requirements of UN/ECE Regulation No. 14-07.

Class I, II and III buses shall from 1 January 2023 meet the requirements for frontal protection described in Section 5 of UN/ECE Regulation No. 29 when the collision test has been carried out in accordance with Annex 3 Test A where the impact value of the impactor shall be in accordance with Section 5.5.2.

Section 5. (Repealed)

Section 6. Requirements applying to passenger cars

Passenger cars shall satisfy the requirements of Annex XI, Appendix 3 “Wheel-chair Accessible Vehicles”, of Directive 2007/46/EC. In addition, the following shall apply:

a) Wheelchair spaces shall be in accordance with Annex 8 Section 3.6.1. of UN/ECE Regulation 107-05.

b) Seats in the wheelchair area shall be in accordance with Annex 8 Section 3.7. of UN/ECE Regulation 107-05.

c) Lighting shall be in accordance with Annex 3 Section 7.6.12. of UN/ECE Regulation 107-05.

d) Lift, ramps and similar shall be in accordance with Annex 8 Section 3.11. of UN/ECE Regulation 107-05.

e) Space for fire extinguishers and first-aid equipment shall be provided in accordance with Annex 3 Section 7.5.4. of UN/ECE Regulation 107-05.

f) Work lights shall be in accordance with Section 28-5 (8) of the Regulations relating to the Technical Requirements and Approval of Vehicles.

Section 7. Enforcement

Buses covered by these Regulations shall at all times comply with the requirements in Section 4 when carrying out licensed transport, cf. however Section 8.

Passenger cars covered by these Regulations shall at all times comply with the requirements in Section 6 when carrying out licensed transport, cf. however Section 8.

The Norwegian Public Roads Administration and the police carry out inspections to enforce these Regulations. In the event of inadequate equipment or use of materials that do not meet the requirements of the Regulations or perform adequately, Sections 40 and 41 of the Professional Transport Act shall apply accordingly.

Section 8. Exemptions

For vehicles covered by these Regulations, the Norwegian Public Roads Administration may in individual cases grant exemption from one or more of the requirements in Sections 4 and 6. No exemption may be made from the requirements for boarding aids, restraint systems (tie-down mechanisms) for wheelchairs, seat belts, fire extinguishing equipment, first aid equipment and work lights. For the requirements in Section 4, second paragraph, the licensing authority may also grant exemptions.

Section 9. Entry into force and transitional provisions

These Regulations shall enter into force on 1 January 2010.

Agreements on the purchase of new means of transport entered into after 1 January 2010 shall comply with the requirements of these Regulations. Means of transport that have been previously approved and that are altered or modified may be approved in accordance with Section 3.

Vehicles approved pursuant to Regulations of 4 January 1984 No.599 relating to licensed transport of disabled persons - technical vehicle requirements, will still be considered approved for licensed transport of disabled persons.

The Regulations of 4 January 1984 No. 599 relating to licensed transport of disabled persons - technical vehicle requirements, are repealed as of 1 January 2010.

I forskrift 3. desember 2009 nr. 1438 om universell utforming av motorvogn i løyvepliktig transport mv. gjøres
følgende endringer:
§ 1 skal lyde:
Forskriften gjelder for løyvepliktig persontransport i rute og i løyvepliktig transport hvor motorvognen
brukes til transport for personer med nedsatt funksjonsevne, jf. yrkestransportlova § 4, § 6 og § 9. Forskriften
gjelder ikke buss klasse I, med unntak av § 4 femte ledd. § 4 femte ledd gjelder all løyvepliktig persontransport,
både i og utenfor rute.
§ 4 nytt femte ledd skal lyde:
Buss i klasse I, II og III som omfattes av forskriften og som førstegangsregistreres i Norge fra og med 1.
oktober 2023 skal tilfredsstille kravene til frontbeskyttelse beskrevet i FN-regulativ nr. 29 pkt. 5 når
kollisjonstesten er gjennomført i henhold til vedlegg 3 test A der anslagsverdien for pendelen skal være i
henhold til pkt. 5.5.2. Vilkårene i pkt. 5.1.6 kan benyttes som alternativ til mekanisk prøving.
