Explanation

The submitted draft decree follows up on the amendment to the Gambling Act, practical experience and technological developments.

Summary

The subject of the notification is the draft Decree on the conditions for the operation of gambling games, which is issued on the basis of authorisation pursuant to Section 133(1)(a), (e) and 2(c) and (d) of Act No 186/2016 on gambling, as amended by the Government’s draft act amending certain acts in connection with the consolidation of public budgets with expected effect from 1 January 2024 (hereinafter the ‘Gambling Act’). This draft decree lays down the conditions for the operation of gambling games with regard to the protection of health, property or other public interest or to ensure effective supervision of compliance with obligations under the Gambling Act. These are detailed conditions for the operation of individual types of gambling games, such as the essentials of an instant-win lottery ticket. Furthermore, the draft decree sets out prohibited risk bonuses that the operator of a gambling game may not grant in connection with the operation of the gambling game to its participants. A risk bonus is a bonus that promotes risky gambling or threatens health, life, good morals or public order. In the draft decree, the Ministry of Finance also lays down the details of compliance with the recording obligation and defines the manner of notification and transmission of information and transmission, the content requirements and time limits for the notification, storage or transmission of information from operators of gambling games to state authorities in the area of gambling game operation.

Pursuant to Section 133(1)(a), (e), 2(c) and (d) of Act No 186/2016 on gambling (hereinafter
the ‘Act’), the Ministry of Finance lays down:

(1) A risk bonus is a prohibited risk bonus if any offer to obtain such a bonus or other
promotional message relating to that bonus does not include all the conditions for a gambling
game participant to acquire or use it or unless these conditions are demonstrably
communicated to the participant before it is acquired.
(2) A bonus is always a prohibited risk bonus if
a) the conditions for its acquisition or use encourage competition based on a comparison of
the frequency of participation, the amount of stakes or winnings of gambling game
participants;
b) its acquisition or use is contingent on the participant not withdrawing funds or part
thereof from the user account; or
c) if it is provided after the operator receives a request to cancel the user account.
PART TWO
GENERAL PROVISIONS FOR RECORDING AND REPORTING OBLIGATIONS
Section 2
General period for keeping records
Unless otherwise laid down by the Act, an operator is obliged to keep recordings, records
and related documents for a period of 3 years from the date they were recorded.
