The purpose of the Royal Decree is to transpose Directive 2018/852 of 30 May 2018 and to adapt the Spanish legislation on packaging to the new extended producer responsibility scheme established by Directive 2018/851 of 30 May 2018 and Directive 2019/904 of 5 June 2019 as regards packaging within its scope, once it has been incorporated into Law 7/2022 of 8 April on contaminated waste and soils for a circular economy.
The RD sets out obligations for precaution, reuse and design in order to move towards a circular economy. The RD reviews the extended producer responsibility (APR) scheme for household packaging after almost 25 years of application of Law 11/1997 of 24 April to bring it into line with the new regulation established at Community level and transposed by Law 7/2022 of 8 April on contaminated waste and soils for a circular economy. In addition, the APR scheme applies to commercial and industrial packaging, which have generally been exempted.
